2. SÖZLEŞMENİN KONUSU

İşbu Mesafeli Satış Sözleşmesi'nin konusu, ALICI'nın www.maverahome.com internet sitesi üzerinden elektronik ortamda sipariş verdiği ürünün satışı, ödemesi ve teslimine ilişkin tarafların hak ve yükümlülüklerinin belirlenmesidir.

3. ÜRÜN BİLGİLERİ

Satın alınan ürünün adı, adedi, ürün fiyatı, varsa kargo ücreti ve toplam sipariş bedeli, sipariş oluşturulmadan önce ALICI'ya gösterilir.

4. SİPARİŞ VE ÖDEME

ALICI, siparişini onaylamadan önce ürün bilgilerini ve toplam ödeme tutarını incelemiş olduğunu kabul eder.

Ödeme, internet üzerinden sunulan ödeme yöntemleriyle veya sipariş sırasında sunulması halinde kapıda ödeme yöntemiyle gerçekleştirilebilir.

Kapıda ödeme seçeneğinde ürün bedeli teslimat sırasında tahsil edilir.

5. TESLİMAT

Sipariş, ALICI tarafından sipariş sırasında belirtilen teslimat adresine gönderilir.

Siparişlerin teslimat süresi, ürün sayfasında veya sipariş sırasında belirtilen süre içerisinde gerçekleştirilir. Taahhüt edilmiş özel bir süre bulunmaması halinde, yürürlükteki mevzuatta öngörülen azami teslim süresi uygulanır.

Teslimatın ALICI tarafından verilen yanlış veya eksik bilgiler nedeniyle gerçekleştirilememesinden kaynaklanan durumlarda ilgili mevzuat hükümleri uygulanır.

6. CAYMA HAKKI VE HİJYEN İSTİSNASI

ALICI, yürürlükteki mevzuat kapsamında, malın kendisine veya belirlediği üçüncü kişiye tesliminden itibaren 14 gün içerisinde herhangi bir gerekçe göstermeksizin cayma hakkını kullanabilir.

Ancak ürünümüz doğrudan ciltle temas eden kişisel bakım ve hijyen ürünü olduğundan, ürünün ambalajı, koruyucu bandı, mührü veya benzeri koruyucu unsurlarının açılmış olması ve bu nedenle ürünün sağlık ve hijyen açısından yeniden satışa uygun olmaması halinde, yürürlükteki mevzuat kapsamında cayma hakkı kullanılamaz.

Bu nedenle ürünün ambalajının kullanım öncesinde açılmadan kontrol edilmesi önerilir.

Ürünün ayıplı olması, hasarlı teslim edilmesi veya sipariş edilenden farklı bir ürün gönderilmesi gibi yasal hakların doğduğu durumlar bu kapsamın dışındadır.

7. ÜCRET VE İADELER

Cayma hakkının mevzuata uygun şekilde kullanılabildiği durumlarda, ilgili bedel yürürlükteki mevzuat hükümlerine uygun şekilde iade edilir.

Ödemenin iadesi, mümkün olduğu ölçüde ALICI'nın satın alma sırasında kullandığı ödeme yöntemine uygun şekilde gerçekleştirilir.

8. KİŞİSEL VERİLER

ALICI tarafından sipariş sırasında paylaşılan kişisel bilgiler, siparişin oluşturulması, ödeme işlemlerinin gerçekleştirilmesi, ürünün teslim edilmesi, müşteri hizmetlerinin sağlanması ve yasal yükümlülüklerin yerine getirilmesi amacıyla işlenebilir.

Kişisel verilerle ilgili ayrıntılar Gizlilik Politikası kapsamında açıklanmaktadır.

9. UYUŞMAZLIKLAR

İşbu sözleşmeden doğabilecek uyuşmazlıklarda yürürlükteki tüketici mevzuatı uygulanır.

Tüketicilerin yasal hakları kapsamında ilgili Tüketici Hakem Heyetleri ve Tüketici Mahkemelerine başvuru hakları saklıdır.

10. YÜRÜRLÜK

ALICI, siparişi onaylamadan önce işbu sözleşmenin ve siparişe ilişkin ön bilgilerin kendisine sunulduğunu kabul eder.

Siparişin ALICI tarafından onaylanmasıyla birlikte işbu sözleşme yürürlüğe girer.

DISTANCE SALES AGREEMENT

2. SUBJECT OF THE AGREEMENT

This Distance Sales Agreement governs the sale, payment, and delivery of products ordered electronically by the CUSTOMER through www.maverahome.com and defines the rights and obligations of the parties.

3. PRODUCT INFORMATION

The product name, quantity, price, applicable shipping fee, and total order amount are displayed to the CUSTOMER before the order is placed.

4. ORDER AND PAYMENT

The CUSTOMER acknowledges that they have reviewed the product information and total amount before confirming the order.

Payment may be made through the payment methods available on the website or, where offered, by cash on delivery.

For cash-on-delivery orders, the product amount is collected upon delivery.

5. DELIVERY

The order will be delivered to the delivery address provided by the CUSTOMER during checkout.

Orders will be delivered within the period stated on the product page or during the ordering process. Where no specific delivery period has been promised, the maximum delivery period provided by applicable law shall apply.

6. RIGHT OF WITHDRAWAL AND HYGIENE EXCEPTION

The CUSTOMER may exercise the statutory right of withdrawal within 14 days from the delivery of the product, without providing a reason, subject to applicable law.

However, because our product is a personal care and hygiene product that comes into direct contact with the skin, the right of withdrawal does not apply where the product's packaging, protective seal, or similar protective element has been opened and the product is therefore unsuitable for resale for health or hygiene reasons.

Customers are therefore advised to inspect the product and its packaging before opening or using the product.

This provision does not affect statutory rights applicable to defective, damaged, or incorrectly delivered products.

7. PAYMENTS AND REFUNDS

Where the right of withdrawal is legally applicable and properly exercised, refunds will be processed in accordance with applicable law.

Refunds will, where applicable, be made using the same payment method used by the CUSTOMER for the original purchase.

8. PERSONAL DATA

Personal information provided by the CUSTOMER during the ordering process may be processed for order fulfillment, payment processing, delivery, customer service, and compliance with legal obligations.

9. DISPUTE RESOLUTION

Applicable consumer protection laws shall govern disputes arising from this agreement.

The CUSTOMER retains all statutory rights to apply to the relevant consumer dispute resolution authorities and courts.

10. EFFECTIVENESS

The CUSTOMER acknowledges that this agreement and the relevant pre-contractual information have been made available before confirming the order.

This agreement becomes effective when the CUSTOMER confirms the order.
